Accommodation Terms and Conditions (Gakuroku Suien)
Terms and conditions (Scope of application)
Article 1 Accommodation contracts and related contracts entered into by this hotel with guests shall be in accordance with the provisions of these terms and conditions, and matters not stipulated in these terms and conditions shall be subject to laws and regulations (or those based on laws and regulations). (hereinafter the same shall apply) or in accordance with generally established customs.
2. If our hotel agrees to a special agreement within the scope of laws and customs, that special agreement shall take precedence, regardless of the provisions of the preceding paragraph.
(Application for accommodation contract)
Article 2 A person who wishes to apply for an accommodation contract with our hotel must provide the following information to our hotel.
(1) Guest name.
(2) Accommodation date and estimated time of arrival.
(3) Accommodation charges (as a general rule, according to the basic accommodation charges in the Attached Table 1).
(4) Other matters deemed necessary by our hotel.
2. If a guest requests to continue staying beyond the accommodation date set forth in Paragraph 2 of the preceding paragraph during their stay, the hotel will treat the request as applying for a new accommodation contract at the time the request is made.
(Establishment of an accommodation contract, etc.)
Article 3 An accommodation contract is entered into when the hotel accepts a guest’s application in accordance with the terms set forth in the preceding article. However, this does not apply if the hotel proves that it has not given consent.
2. When an accommodation contract is entered into in accordance with the provisions of the preceding paragraph, the application fee for the entire accommodation period must be paid by the date specified by the hotel.
3. The application fee will first be applied to the accommodation fee that the guest will ultimately have to pay, and in the event that the provisions of Articles 6 and 18 apply, the application fee will be applied to the cancellation fee and then to the compensation. However, if there is any remaining balance, it will be returned at the time of payment of fees pursuant to the provisions of Article 12.
4. If the application fee set forth in Paragraph 2 is not paid by the date specified by the hotel pursuant to the provisions of the same paragraph, the accommodation contract shall become invalid. However, this only applies if the hotel notifies the guest of this when specifying the due date for payment of the application deposit.
(Special agreement that does not require payment of the application fee)
Article 4 not withstanding, the provisions of Paragraph 2 of the preceding article, the hotel may accept a special agreement in which the payment of the application fee set forth in the same paragraph is not required after the conclusion of the contract.
2. If the hotel does not request the payment of the application fee as set forth in Paragraph 2 of the preceding article or does not specify the payment date for the application deposit when accepting an application for an accommodation contract, it will be treated as acceptance of the special agreement set forth in the preceding paragraph.
(Request for cooperation regarding infection prevention measures at all facilities)
Article 4-2 The hotel may request the cooperation of those who wish to stay in accordance with the provisions of Article 4-2, Paragraph 1 of the Hotel Business Act (Act No. 138 of 1942).
(Refusal to make an accommodation contract)
Article 5 The hotel may not agree to the creation of an accommodation contract in the following cases. However, this paragraph does not mean that our hotel may refuse accommodation in cases other than those listed in Article 5 of the Hotel Business Act.
(1) When the application for accommodation does not comply with these terms and conditions.
(2) When there are no rooms available due to full occupancy.
(3) When it is recognized that there is a risk that the person seeking accommodation may violate the provisions of laws and regulations, public order, or good morals regarding accommodation.
(4) When the person seeking accommodation is deemed to fall under any of the following (a) to (c).
a. Organized crime group members (hereinafter referred to as “organized crime groups”) as stipulated in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991), as stipulated in Article 2, Item 6 of the same. Organized crime group members (hereinafter referred to as “organized crime group members”), semi-members of organized crime groups, people associated with organized crime groups, and other anti-social forces.
b. When the organized crime group or organized crime group member is connected to a corporation or other organization that controls business activities.
c. When a corporation has an officer who is a member of an organized crime group.
(5) When the person seeking accommodation is a patient with a specified infectious disease, etc., as stipulated in Article 4-2, Paragraph 1, Item 2 of the Hotel Business Act (hereinafter referred to as “Patient with a Specified Infectious Disease, etc.”).
(6) When violent demands are made regarding accommodation or a burden that exceeds a reasonable range is demanded of the hotel (Act on Promotion of Elimination of Discrimination on the Grounds of Disability (2013)) No. 65 (hereinafter referred to as the “Act on Eliminating Discrimination against Persons with Disabilities”).
(7) A person seeking lodging makes a request to the hotel related to the Hotel Business Act that would impose an excessive burden on the hotel and seriously impede the provisions of accommodation-related services to other guests. When repeating what is prescribed in Article 5-6.
(8) When accommodation is not possible due to natural disasters, facility failures, or other unavoidable reasons.
(9) When the case falls under Article 6 of the Yamanashi Prefecture Hotel Business Act Enforcement Ordinance.
(Explanation of refusal to enter into an accommodation contract)
Article 5-2: If the hotel does not agree to an accommodation contract based on the preceding article, the person seeking accommodation may request an explanation of the reason.
(Guest’s right to cancel a contract)
Article 6 The guest may cancel the accommodation contract by notifying the hotel.
2. If the guest cancels all or part of the accommodation contract due to reasons attributable to the guest (in accordance with the provisions of Article 3, Paragraph 2, the hotel specifies the payment date of the application fee and requests payment) (excluding cases where the guest cancels the accommodation contract before the payment is made), a penalty will be charged as set forth in Attached Table 2. However, if our hotel accepts a special agreement under Article 4, Paragraph 1, in accepting the special agreement, on occasion, our hotel will notify the guest of the obligation to pay a penalty if the guest cancels the accommodation contract..
3. If the guest does not arrive by 5:00pm on the day of accommodation (if the expected arrival time is specified, 2 hours after that time) without contacting the hotel, the accommodation contract will be terminated. It may be treated as if it has been canceled by the guest.
(Right of our hotel to cancel the contract)
Article 7 The hotel may cancel the accommodation contract in the following cases. However, this paragraph does not mean that our hotel may refuse accommodation in cases other than those listed in Article 5 of the Hotel Business Act.
(1) When the guest is deemed to be at risk of committing an act that violates the provisions of laws and regulations, public order, or good morals regarding accommodation, or when it is recognized that the Guest has committed the any of the same acts.
(2) When the person seeking accommodation is deemed to fall under any of the following A to C.
a. A Boryokudan, a member of an organized crime group, a quasi-member of an organized crime group, a person associated with an organized crime group, and any other anti-social forces.
b. When the organized crime group or organized crime group member is connected to a corporation or other organization that controls business activities.
c. When a corporation has an officers who is a member of an organized crime group.
(3) When the guest is a patient of a specified infectious disease.
(4) When a violent demand is made regarding accommodation or a burden exceeding a reasonable range is requested of the hotel (a person seeking accommodation is subject to social barriers pursuant to the provisions of Article 7, Paragraph 2 of the Act on the Elimination of Discrimination against Persons with Disabilities).
(5) The enforcement Regulations of The Hotel Business Act states that a person seeking accommodation may make a request to the hotel that would impose an excessive burden on the hotel and that would seriously impede the provision of accommodation-related services to other guests. In this case, (5-6) the hotel may cancel the accommodation contract if the request is repeated as stated in 5-6.
(6) When accommodation is not possible due to reasons beyond the hotel’s control such as natural disasters.
(7) When the case falls under Article 6 of the Yamanashi Prefecture Hotel Business Act Enforcement Ordinance.
(8) If a guest smokes while lying down in the bedroom or tampers with firefighting equipment, etc., and fails to comply with any other prohibitions set forth by the hotel’s rules of use.
2. If the hotel cancels the accommodation contract based on the provisions of the preceding paragraph, the guest will not be charged for accommodation services, etc. that have not yet been provided to the guest.
(Explanation of cancellation of an accommodation contract)
Article 7-2 If the hotel cancels the accommodation contract based on the preceding paragraph, the guest may request an explanation of the cancelation reason.
(Registration of accommodation)
Article 8 Guests must register the following information with the hotel on the day of their stay.
(1) Names, ages, addresses, and contact information of all guests
(2) For foreigners, nationality and passport number
(3) Other matters deemed necessary by our hotel.
2. If the guest intends to pay the charges set forth in Article 12 using a method that can be substituted for currency, such as a credit card, the guest will be required to present such payment in advance at the time of registration as set forth in the preceding paragraph.
(Room usage time)
Article 9 guests may use the hotel from 12:00 to 12:00 the next day. However, if you stay for consecutive nights, you can use it all day except for the day of arrival and the day of departure.
2. Notwithstanding the provisions of the preceding paragraph, the hotel may accept the use of guest rooms outside of the hours specified in the same paragraph. In this case, you will be charged the following additional charges.
(1) For up to 3 extra hours, 1/3 of the amount equivalent to the room charge
(2) For up to 6 additional hours, two-thirds of the amount equivalent to the room charge
(3) For over 6 hours or more, the full amount equivalent to the room charge
3. The amount equivalent to the room charge in the preceding paragraph shall be 100% of the basic accommodation charge.
(Compliance with usage rules)
Article 10 Guests must comply with the usage rules established by the hotel while inside the hotel.
(Business hours)
Article 11 For inquiries regarding the use of this hotel during your stay, please use the contact information provided on the day of your stay. The business hours of this contact point are from 8:00 to 20:00.
2. The time stated in the preceding paragraph may be changed temporarily if necessary. In that case, we will notify you by an appropriate method.
3. For urgent inquiries outside of business hours, please use the contact information provided on the day of your stay.
(Payment of fees)
Article 12 The details of accommodation fees, etc. to be paid by the guest are as follows.
(1) Basic accommodation fee (room fee)
(2) Food, drink and other optional charges
(3) Fees associated with services
(4) Consumption tax
2. Payments in (1) and accompanying (4) of the preceding paragraph shall be made by a payment method approved by the Hotel when requested by the hotel.
3. Payments in paragraphs (2) and (3) of Paragraph 1, and accompanying (4), must be made at the time of departure or when requested by the hotel, using a payment method approved by the hotel.
4. Even if the guest voluntarily chooses not to stay after the hotel has provided a guest room to the guest and the guest is able to use the room, accommodation fees, etc. will still be charged.
(Responsibility of our hotel)
Article 13 If the hotel causes damage to the guest in the performance of the Accommodation Contract and related contracts, or as a result of non-performance thereof, the hotel shall compensate the guest for such damage. However, this dose not apply if the damage is not due to reasons attributable to the hotel. However, damage such as malfunctions of equipment and fixtures will not be covered unless the malfunction makes it impossible to use this accommodation contract.
2. Our hotel has inn liability insurance to deal with any unexpected accidents.
(Provisions for when a contracted guest room cannot be provided)
Article 14 If the hotel is unable to provide the guest with the contracted room, the hotel will still not provide the guest with other accommodations with similar conditions.
2. In the case of the preceding paragraph, the hotel will pay the guest a compensation fee equivalent to the penalty, and the compensation fee will be applied to the amount of damages. However, if the reason the hotel is unable to provide the guest with the contracted room is not attributable to the hotel, no compensation fee will be paid.
(Handling of deposited items, etc.)
Article 15 the hotel cannot keep goods, cash, or valuables belonging to guests.
2. The hotel will compensate the guest for damage only if the goods, cash, or valuables brought into the hotel by the guest are lost or damaged due to the hotel’s lack of care or negligence. However, for items for which the type and value of have not been disclosed in advance by the guest, the hotel will compensate the guest for damage up to 100,000 yen, unless there is intentional or gross negligence on the part of the hotel.
(Storage of guest’s baggage or personal effects)
Article 16 The Hotel shall not store the guest’s baggage or personal belongings, even if they arrive at the Hotel prior to the guest’s stay. However, if an agreement is reached between the guest and the hotel regarding the storage of baggage or personal effects, it will be stored and handed over to the guest when checking in to the hotel.
2. If the guest’s baggage or personal belongings are left behind at the hotel after the guest has checked out, and the owner is identified, the hotel will contact the owner and request instructions. However, if there is no instruction from the owner or if the owner cannot be identified, the item will be kept for 7 days including the date of discovery and then delivered to the nearest police station.
3. In the case of the preceding two paragraphs, the responsibility of the hotel for the storage of the guests’ baggage and personal effects shall be the same as in the case if paragraph 1. In the case of Paragraph 1, the provisions of Paragraph 1 of the same Article shall apply; in the case Paragraph 2, the provisions of Paragraph 2 of the same Article shall apply.
(Parking Responsibility)
Article 17 When a guest uses the hotel’s parking lot, the hotel rents out the space and does not assume any responsibility for managing the vehicle, regardless of whether or not the vehicle key is entrusted to the guest. However, in the event that damage is caused intentionally or negligently by the hotel in managing the parking lot, the hotel will be held responsible for compensation.
(Guest’s responsibility)
Article 18 If the hotel suffers damage due to the guest’s intention or negligence, the guest shall reimburse the hotel for the damage. We will ask you to compensate us.
2. All keys for the hotel’s entrance that the guest received from the business operator at the time of check-in must be returned to the business operator at the time of check-out. In the unlikely event that the key is not returned due to loss, etc., you will be required to pay 30,000 yen as the replacement cost for the main unit and key.
(Entry by non-guests)
Article 19 If a person or persons other than ones stated by the guest at the time of the application for accommodation enters the hotel, the guest must notify the hotel in advance. In this case, the guest must submit the name and contact information of the person requesting such access to the hotel.
2. Even if the hotel approves, a restriction will be set at 10:00 p.m. If the person or persons enters the hotel after that time, a penalty of 50,000 yen per person may be charged to the guest. However, this does not apply if the maximum number of guests staying is less than 6 people and the hotel approves.
(Status quo confirmation)
Article 20 At the time of the start of use, the guest shall be responsible for the facilities and equipment in the hotel, as well as the furnishing items and artworks on display.
We will confirm with the business operator whether there is any damage, defacement, or malfunction in the furniture, etc.
2. If the guest confirms the existence of damage, defacement, or malfunction in the preceding paragraph, the guest shall report it to the business operator.
3. If the guest fails to make a report as set forth in the preceding paragraph, the guest agrees that the damage, defacement, or malfunction, etc. set forth in Paragraph 1 will be deemed not to exist at the time the guest begins using the Hotel.
4. At the end of the stay, if there is any damage, defacement, or malfunction in the facilities and equipment that have not been reported in paragraph 2, as well as to the displayed artworks, art objects, or furniture, etc., Pursuant to Article 18, the guest shall compensate the hotel for any damage caused to the item/area.
(Entry by the business operator)
Article 21 The business operator and the manager entrusted by the business operator may enter the hotel even when the hotel is occupied by guests in the event of an emergency, when contact with the guest cannot be made, or when the business operator deems it necessary.
2. For matters other than those mentioned in the preceding paragraph, the prior consent of the guest shall be obtained.
(Prohibited matters)
Article 22 The guests shall make an accommodation contract with the understanding that any and all of the following acts are prohibited.
(1) Acts that lead to damage or defacement of tangible cultural properties
(2) Acts that cause a fire on the premises
(3) Smoking and barbecuing on the premises
(4) Entry into restricted areas set up by our facility
(5) Rough handling of the building’s fittings, furniture, and other equipment, and acts that damage the Tatami mats.
(6) Actions that lead to damage or defacement of works of art, or furniture displayed in the hotel,
or the act of moving an item.
(7) Animals, birds, and other pets in general
(8) Bringing in stimulants, narcotics, and items prohibited by firearms laws.
(9) Bringing in flammable or easily ignitable items, explosives, or other dangerous items.
(10) Items that affect facility management, such as items that emit bad odors.
(11) Accommodation by persons other than those stated by the guest on the contract at the time of contract .application, or entry by persons without permission from the hotel.
(12) Accommodation for persons outside the applicable age range (under 12 years old).
(13) Use for purposes other than lodging, such as business activities without permission from the hotel.
(14) Gambling or acts that disturb public morals within the facility.
(15) Acts of using videos and photos taken at our hotel for business purposes without permission.
(16) Acts that cause trouble to neighboring residents.
(17) Actions that cause strong odors to build up in the room.
(18) Modification of the hotel, installation of structures, duplication and replacement of keys.
(19) Acts that violate the privacy or other rights or interests of the business operators.

Article 23 Guests shall enter into an accommodation contract on the premise that they understand and comply with the following terms.
(1) Our hotel does not have full-time staff. In the event of a disaster, guests must take action to protect their own lives.
(2) Guests are responsible for managing the safety and security of fires, theft, etc. during their stay.
(3) For management and crime prevention purposes, security cameras are installed at the entrance gate and in the garden. The images taken by the camera will be strictly managed in accordance with the hotel’s regulations and will be deleted after a certain period of time.
(4) You are free to bring food and drinks into the hotel, have them delivered, etc. However, in the unlikely event that food poisoning occurs, the hotel will not be held responsible.

(Note) 1.% is the ratio of the penalty fee to the basic accommodation fee for the entire stay period for which the application was made.
2. If the number of contract days is reduced, a penalty fee will be collected for the basic accommodation fee for the reduced number of days.
3. Penalties for additional charges (food and beverages and other optional charges) will be posted on the hotel’s website.
4. Penalties different from the above penalties may be determined by accommodation packages, plans, and other special agreements separately planned by our hotel.
